Who you are working with
The Way Back is an independent branding, packaging and web/app design and build studio. We provide digital services and digital deliverables only, not physical goods. Packaging work means the digital design files specified in your quote, not manufactured packaging. The studio is operated by A V D SILVA as an individual, not a registered company. First, agree the work
Before payment, your written quote or project agreement sets out what we will make, the price in USD, payment stages, included revisions, delivery plan and any third-party costs. A brief submission is an inquiry, not project acceptance. Extra work needs a separate agreement and price. We do not add it to your project just because we suggest it.
These terms and the refund policy apply alongside that agreement. Any project-specific exception must be written and agreed before payment. This studio policy does not limit rights that cannot be excluded.
Payment and the first 24 hours
The upfront amount is the amount shown in your accepted quote. Payment is confirmed only after the provider records a successful capture. We do not start project work during the first 24 hours after that capture. You can cancel within that window under our refund policy.
After the window, work can start once the brief, required materials and project agreement are complete. Payment alone is not a promise of immediate delivery.
No rushed work
We do not offer fast-track delivery. Your quote gives the actual schedule. Delays in supplying materials, feedback or approvals can change that schedule; we will explain any change rather than silently move a deadline.
Missing materials or an incomplete agreement can delay the start and delivery.
Your materials and feedback
Give us accurate information and materials you have permission to use. Tell us about any restrictions before work starts. Review the work and tell us clearly what needs changing within the agreed scope. Included revisions are the ones in your quote; a new direction or new deliverable may need a separate quote. Silence is not approval.
Delivery and ownership
Delivery is digital, through the agreed project channel. Your project agreement must state the final digital files, source files, licences, ownership transfer and any ongoing support. Third-party fonts, images, software and hosting may have their own licences and fees. We do not promise rights we cannot transfer. We do not publish your confidential work as a case study without agreed permission.
If something goes wrong
Tell us what is wrong and include your project or payment reference. We will review it against the agreed scope and work on a fair fix. The change-of-mind limits in our refund policy do not excuse failure to provide agreed work, duplicate or incorrect charges, or any rights that cannot be excluded.
Design and build work does not guarantee sales, revenue, platform availability or a particular business result.
Cancellation, refunds and disputes
Read the separate refund policy before paying. PayPal disputes follow PayPal's process. We will follow PayPal's decision for a dispute handled by PayPal. We may provide accurate project, payment, communication and delivery records during that process. This studio policy does not limit rights that cannot be excluded.
Records and changes
Project records include the agreed scope, messages and delivery history. The accepted terms version and payment evidence are tied to the project and transaction. The privacy policy explains how personal information is used. A later website update does not silently replace the terms of an existing project; material changes need agreement.
